If you are an investor or a potential investor in a fund sponsored by Renaissance Technologies LLC, please read the privacy policy below.

Notice of Guernsey Privacy Policy for Investors

Renaissance Technologies LLC and its affiliates (together, "Renaissance") are committed to protecting your privacy and maintaining the confidentiality and security of your personal information. Any personal information processed by Renaissance is controlled by Renaissance, and Renaissance is the data controller of your personal information. When your details are provided to Renaissance as a consequence of your investment (or potential investment) in a private investment fund sponsored by Renaissance Technologies LLC (each, a "Fund"), then Renaissance, acting as a data controller, may itself (or through a third party such as The Bank of New York Mellon (the "Administrator") acting in its capacity as the Fund’s administrator) process your personal information or, if you are an entity, that of your (i) beneficial owner(s); (ii) employees; or (iii) directors, officers, trustees, general partners, managers, or other persons serving in a similar capacity (as distinguished from the entity itself). When processing your personal information, the Administrator may also act as a data controller.

Renaissance’s Guernsey representative is Midshore Consulting Limited, located at Unit 4, Trinity Square Centre, Upper Mansell Street, St Peter Port, Guernsey, GY1 1LY.

This policy (the "Guernsey Investor Privacy Policy") explains the manner in which Renaissance collects, uses, and maintains nonpublic personal information about former, current, and potential investors ("Investors") based in the Bailiwick of Guernsey ("Guernsey") as required under the General Data Protection Regulation (EU) 2016/679 ("GDPR") or The Data Protection (Bailiwick of Guernsey) Law, 2017 ("Guernsey DP Law"), as applicable. This Guernsey Investor Privacy Policy applies to personal information you supply in connection with your investment or potential investment in a Fund ("Your Personal Information").

Please note that this Guernsey Investor Privacy Policy is for informational purposes only and is neither an offer for an investment to nor a solicitation of investors in located in Guernsey.

Collection of Your Personal Information

Renaissance collects Your Personal Information from the following sources, as applicable:

  • subscription documents and other information provided by the Investor in writing, in person, by telephone, electronically, or by any other means (including name, address, income, financial and investment qualifications, tax-related information, birth date, nationality, passport or other identification number, and employment information);
  • transactions within the Fund, including account balances, investments, redemptions, and management fee and performance allocation payments; and
  • other interactions with Renaissance (for example, discussions with our staff).

Your Personal Information will not include special category data (as defined in the Guernsey DP Law).

Reasons for Collecting Personal Information

Renaissance and the Administrator are able to legally collect and use Your Personal Information for one or more of the following reasons:

  • you have consented to their doing so;
  • it is necessary for the performance of a contract to which the Investor is a party or to take steps at the request of the Investor before entering into a contract or to otherwise perform the Services, as defined below;
  • it is necessary for Renaissance or the Administrator to fulfill its legitimate business interests, which may include investigating, defending against, or prosecuting any actual, threatened, or potential claim in a court of law or other judicial or regulatory forum or otherwise protecting its legal rights; or
  • it is necessary to comply with regulatory, judicial, or other legal obligations applicable to Renaissance or the Administrator.

Why We Use Your Personal Information

Your Personal Information may be processed by Renaissance or the Administrator (or any of their affiliates, agents, employees, delegates, or subcontractors) for the following purposes, as applicable:

  • to facilitate your investment in the Fund and the management and administration of your investment in the Fund on an ongoing basis (the "Services") as necessary to fulfill all contractual and regulatory obligations related to your investment in the Fund, including without limitation the acceptance and processing of subscription documents and redemption and transfer requests;
  • to carry out anti-money laundering checks and related actions that Renaissance or the Administrator considers appropriate or necessary to fulfill legal obligations on an ongoing basis in accordance with Renaissance’s and the Administrator’s anti-money laundering policies and procedures (i) with respect to the prevention or detection of fraud, money laundering, terrorist financing, bribery, corruption, or tax evasion and (ii) to prevent the provision of financial and other services to persons who may be subject to economic or trade sanctions;
  • to comply with other legal obligations and, in particular, to report tax-related information to tax authorities;
  • to disclose information to other third parties such as Renaissance’s or the Administrator’s service providers (including, for example, attorneys, accountants, auditors, or other professionals), regulatory authorities, and technology providers to comply with any legal obligation imposed on Renaissance or the Administrator or to pursue Renaissance’s or the Administrator’s legitimate interests;
  • to communicate with you and monitor and record electronic communications and, if applicable, calls for any of the purposes specified herein; or
  • to otherwise pursue Renaissance’s or the Administrator’s legitimate interests relating to your investment or your potential investment in the Fund or to process Your Personal Information when it would be in the public interest.

Renaissance will not use Your Personal Information for materially different, unrelated, or incompatible purposes without notifying you.

Recipients with Whom We Share Your Personal Information

Renaissance may provide Your Personal Information to its affiliates and to firms and individuals that assist it in managing and operating its sponsorship of various private investment funds and have a need for such information, such as the following:

  • the Administrator;
  • custodians or banking agents;
  • firms providing recordkeeping and other administrative services;
  • auditors and accountants;
  • brokers; and
  • attorneys.

We allow those organizations and individuals to handle Your Personal Information only if we are satisfied they take appropriate measures to protect Your Personal Information in compliance with applicable privacy laws.

We or the third parties mentioned above may also share Your Personal Information with the following:

  • the third parties’ own professional advisers;
  • with your approval, your own advisers (such as your attorney or accountant);
  • law enforcement agencies, courts, tribunals, and regulatory boards to comply with Renaissance’s legal and regulatory obligations;
  • other parties that may acquire control or ownership of Renaissance’s business (or their professional advisers) in connection with a significant corporate transaction or restructuring, including a merger, acquisition, asset sale, or initial public offering or in the event of our insolvency; or
  • as otherwise permitted or required by law or authorized by you.

Storage of Your Personal Information

Renaissance’s servers that store Your Personal Information are located in the United States. Renaissance may also transfer Your Personal Information to its service providers located in Bermuda. Either (i) these jurisdictions afford an adequate level of protection for Your Personal Information (as mandated by the Guernsey Data Protection Authority) or, if they do not, (ii) there are appropriate safeguards in place, together with enforceable rights and effective legal remedies for you (such as entering into agreements that incorporate the EU standard contractual clauses and/or the Guernsey Addendum) that will impose obligations no less onerous than those contained in this Guernsey Investor Privacy Policy.

Protection of Personal Information

Renaissance seeks to maintain appropriate technical and organizational measures to ensure an appropriate level of security to address potential risks and protect Your Personal Information, including physical, electronic, and procedural safeguards. However, no method of safeguarding information is completely secure. While Renaissance uses measures designed to protect Your Personal Information, Renaissance cannot guarantee that its safeguards will be effective or sufficient. In addition, you should be aware that internet data transmission is not always secure, and Renaissance cannot warrant that information you transmit to Renaissance is or will be secure.

Retention of Personal Information

Renaissance will retain Your Personal Information for as long as is necessary to fulfil the purpose for which it was collected or to comply with legal, regulatory, accounting, reporting, or internal policy requirements or for the establishment or defense of legal claims.

Your Rights

In certain circumstances, you may have the following rights in relation to Your Personal Information:

  • the right to be informed about Your Personal Information that Renaissance or the Administrator collects from you, uses, and retains;
  • the right to obtain confirmation from Renaissance that Your Personal Information is being collected, used, and retained as described above and access Your Personal Information held by Renaissance or the Administrator;
  • the right to correct Your Personal Information if it is inaccurate or incomplete at any time;
  • the right to request erasure (known as "the right to be forgotten"), which means you can request deletion or removal of Your Personal Information, subject to Renaissance’s or the Administrator’s rights to retain Your Personal Information;
  • the right to block or suppress Renaissance’s or the Administrator’s collecting and or using Your Personal Information;
  • the right not to be subject to automated individual decision making solely on automated processing (including profiling);
  • the right to object to Renaissance’s or the Administrator’s collecting, using, or retaining Your Personal Information when this objection is based on
    • your legitimate interest or the performance of a task in the public interest or
    • your desire not to receive direct marketing even if it is otherwise legally permitted;
  • the right to withdraw your consent to the use of Your Personal Information at any time (please note that when Renaissance or the Administrator requires Your Personal Information to comply with AML or other legal requirements, failure to provide this information will mean that you will be unable to be accepted as an Investor in the Fund or may be mandatorily redeemed from the Fund if you are already an Investor); and
  • the right to lodge a complaint with the supervisory authority found at https://www.odpa.gg/ for Guernsey residents.

Renaissance may need to request specific information from you to confirm your identity and ensure your right to access to Your Personal Information. This is to ensure that Your Personal Information is not disclosed to any person who does not have authority to receive it. Renaissance will endeavor to respond to requests relating to your rights described above within the timelines set out in applicable law.

Further Information

Renaissance reserves the right to change this Guernsey Investor Privacy Policy from time to time, and any such change will be effective upon posting of the revised policy. Your continued use of the Services following Renaissance’s posting of any revised Guernsey Investor Privacy Policy will constitute your acknowledgment of the amended policy.
